Child abuse
Neglect, for example, is also included als child abuse. Child abuse often occurs in the home. For example, by the child’s parents or guardians. This is a form of domestic violence. But other adults can also abuse a child, because the child is dependent on them for care. For example, playgroup leaders, teachers or sports trainers. All forms of abuse: Emotional or mental abuse: an adult regularly scolds the child, is dismissive and hostile to the child, or deliberately frightens the child. Physical neglect: the child does not receive the care and attention he or she needs. Emotional or mental neglect: ongoing lack of positive attention for the child. Ignoring the child’s need for love, warmth, security. This also includes the situation where a child witnesses violence between parents or caregivers. Sexual abuse: sexual touching that an adult forces on a child.
Legal assistance
Victims of domestic violence can be assisted by a lawyer when filing a report or having a restraining order imposed. The Public Prosecution Service may decide to prosecute the suspect of domestic violence. The victim has the right to join the criminal proceedings as an injured party if compensation is sought due to the material and non-material damage suffered as a result of the crime. Mediation can be used in some situations.
International child abduction
If your child has been abducted from abroad to the Netherlands, you can initiate proceedings in the Dutch court to retrieve your child through a return procedure. You will need a lawyer to set up the procedure. An international child abduction occurs when a child is unlawfully transferred to another country or unlawfully held there by a parent with the intention of living there. Unauthorized means contrary to the law of the country where the child had his or her habitual residence and without the consent of the other custodial parent. Unfortunately, you cannot kidnap your child who is abroad. If your child has been abducted to a Treaty Country, the Dutch Central Authority can contact the Central Authority abroad. If mediation is unsuccessful, legal proceedings will be initiated. The foreign Central Authority does this on your behalf. You must take action within one year of the kidnapping. If your child is in a non-Convention country, the Central Authority through the Ministry of Foreign Affairs can try to retrieve your child through diplomatic channels. You will need a lawyer for the procedures and it is advisable to contact the authorities through the lawyer.
